How it Works

Bands can submit for free, courtesy of maurices. In January, all eligible bands will be added to a round of public voting at http://www.mauricesmusic.sonicbids.com, where they’ll get their music in front of millions of visitors to the site and get their fans to help them reach the next round by voting.



At the end of the first round of voting, the Top 50 bands will move on and be reviewed by a panel of esteemed music industry judges, who will then select the Top 4 bands. These 4 finalists will have their music featured in maurices stores and on the mauricesmusic site in February for another round of voting to determine the Grand Prize Winner.

1. Eligibility: This Contest is open to legal U.S. residents of the 50 United States and the District of Columbia, who are in a band and are 18 years of age or older in their jurisdiction of permanent residence as of December 5, 2011, with an active e-mail address at time of entry. The term band as used herein shall refer to a music group that: a) performs music; and b) does not currently have an exclusive recording arrangement with any recording label that would render the group incapable of granting the rights that an entrant, Semi-finalist, Finalist or the Grand Prize Winner is required to grant in accordance with these Official Rules. This Contest is void where prohibited by law. Employees, officers and directors of Sponsor, its affiliates, subsidiaries, agents, retailers, distributors, wholesalers, and advertising and promotion agencies, and members of the immediate families (defined for these purposes as parents, spouse, children, siblings, grandparents, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate. Proof of eligibility may be required.

2. Entry Period: Eligible entrants may enter only from 12:01:01 am Eastern Time (ET) on December 5, 2011 to 11:59:59 pm ET on December 28, 2011 (the Entry Period).

3. How to Enter: To enter the Contest, visit www.sonicbids.com/hometownsound or www.mauricesmusic.sonicbids.com and follow the instructions to complete and submit an entry form along with a Electronic Press Kit (EPK),which must include at least one (1) of your bands MP3 music files (maximum file size: 5MB). Limit one (1) entry per band for the entire Entry Period. Only one (1) member of a band may submit an entry on behalf of his/her band, but the names of all members of each band must be listed on the submitted entry form. Each entry submitted will be deemed submitted on behalf of all of the band members identified on the official entry form. By submitting an entry, the band member doing so represents and warrants that s/he has received permission to enter the Contest from each member of his/her band listed on the official entry form, and to submit each of their names and the recording(s) of their performance(s) that are included with the submitted entry. The terms contestant or entrant as used herein shall refer to each band in its entirety and not to the person who actually submitted the entry on his/her bands behalf. Once an entry has been submitted, the band may not add or remove any members. All entries, including all material submitted with the entries shall be subject to the terms and conditions set forth in Section 8 herein as well as all other applicable provisions of these Official Rules and will not be returned. These Official Rules are intended, in part, to enable consumers to view and listen to your bands submitted song(s)/performance(s) at http://mauricesmusic.sonicbids.com (Contest Website), a microsite hosted by the Sponsor and produced and powered by Sonicbids Corporation (Sonicbids) for voting purposes in connection with this Contest (see voting details in Rule 3, below). The entry form and all elements included with it, including your song(s), EPK and all other required material, constitute and will be referred to herein collectively as an entry. All Contest entries must be received during the Entry Period, as defined above. Proof of submission of an entry will not be deemed proof of receipt by Sponsor or its agents. Entries must comply with all submission requirements and content restrictions described in Rule 9, below. Read all such requirements and restrictions carefully before you submit an entry.

All song entries must comply with the Song Entry Technical and Content Requirements below.
Song Entry Technical Requirements:
Song submissions:
o MUST be in MP3 format.
o MUST be no larger than 5MB in file size.
o MUST be clear and audible.

Song Entry Content Requirements:

Song submissions MUST NOT have been submitted previously in a contest of any kind, or previously accepted for broadcast or publication in any medium.
Song submissions MUST NOT contain material that violates or infringes anothers rights, including but not limited to, material that violates privacy, publicity, or intellectual property rights, or that constitutes copyright infringement.
Song submissions MUST NOT include mention or performance of any copyrighted media production, including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property, other than material in which the entrant owns copyrights.
Song submissions MUST NOT contain references to any logos, brand names, trademarks, or insignia, except those of the entrant or Sponsor.
Song submissions MUST NOT contain material that is hateful, tortious, defamatory, slanderous, or libelous.
Song submissions MUST NOT contain material which is (or promotes activities which are), in Sponsors sole discretion: sexually explicit, obscene, lewd, pornographic, inappropriate, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, etc.), hateful, offensive, threatening, profane, or harassing; or contain material that is threatening to any person, place, business, group or world peace; or contain words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group; or contain images, words or other material portraying nudity, acts of violence, or acts that are or appear to be unlawful or dangerous.
Song submissions MUST only feature members of the entrant band who are listed on the entry form submitted by the entrant.
Song submissions MUST NOT include material that is unlawful, in violation of, or contrary to the laws or regulations in any state where the song was created.
Song submissions MUST be the contestants original idea (modification of an original work is not an original idea). Song submissions MUST NOT copy or otherwise plagiarize from any source. Cover songs or samples are not permitted for entry or to be played live in any performances associated with this contest. Please note: Entries containing covers of copyrighted songs or songs containing samples will be disqualified and the corresponding band and each of its members shall be ineligible for participation in this Contest.

Sponsor is not responsible for: (i) electronic transmissions/entries/votes that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants or any persons computer and/or its contents, or causes beyond Sponsors reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest, or (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified. All incomplete or non-conforming entries will be disqualified. If for any reason this Contest cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate this Contest. If the Contest is terminated before the original end date, Sponsor reserves the right to select, along with the panel of judges, Grand Prize Winner on the basis of the Round 2 judging criteria from among those eligible, non-suspect entries already received as of the termination time/date. Sponsor reserves the right at their sole discretion to disqualify any entrant it finds to be tampering with or attempting to tamper with the entry/voting process or the general operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or entrant.

4. Selection of Semi-Finalists, Finalists and Grand Prize Winner. A total of fifty (50) Semi-Finalists, four (4) Finalists, three (3) runners-up and one (1) overall Grand Prize Winner will be chosen in a three-round process as follows:
Round 1: Initial Public Voting. Beginning at or around 12:00:01 pm ET on January 9, 2012 and ending at 11:59:59 pm ET on January 23, 2012 (the Initial Voting Period), any person, including band members, may access http://mauricesmusic.sonicbids.com and vote for entries posted on the Contest Website that are his/her favorites. Limit one (1) vote per person/ e-mail address per day. Voting will be subject to the terms of use of the Contest Website and to any additional voting instructions that may be posted on the Contest Website. All first round votes must be received by 11:59:59 pm ET on January 23, 2012.

Any individual or group engaged in vote manipulation or fraudulent voting practices in violation of these Official Rules, including but not limited to the use of any robotic, automatic, mechanical, programmed or similar method to submit votes, may be in violation of criminal and civil laws and may be subject to legal action by Sponsor or its agents, and all votes submitted thereby will be disqualified. If Sponsor determines that a member of any band that is an entrant in the Contest is involved in such prohibited activity, all of that bands votes shall be deemed void, and the band and all members of it will be disqualified from the Contest and will not be eligible to receive a prize.

Following the conclusion of the Initial Voting Period, all valid votes received by each band will be counted. The fifty (50) bands that receive the highest number of valid votes will be declared Semi-Finalists, and will advance to Round 2 of the selection process, as described below. In the event of a tie for a spot in the top fifty (50) bands, all tied bands will proceed to Round 2 as Semi-Finalists.

Round 2: Judging by maurices. Beginning on or about January 23, 2012, a panel of judges will review the fifty (50) bands (or more if there is a tie, as described above) that received the highest number of votes as the Semi-Finalists. The judges will evaluate the bands based on the following criteria to select the four (4) Finalists: originality (25%); the bands professionalism of recording (25%); and the bands overall marketability (50%) (Judging Criteria). The Finalists selected through the judging in Round 2 will be notified by mail, email and/or telephone on or about January 27, 2012 and will be announced to the public. All Finalists will advance to Round 3, described below. All decisions of the judges are final. In the event of a tie, the tied band with the highest score in overall marketability will be declared the Finalist.

Round 3: Final Public Voting. Beginning February 6, 2012 and ending on March 4, 2012, (the Final Voting Period), members of the public will be able to vote for their favorite Finalist band. For a 6-day period during the Final Voting Period, each Finalist band will have their music featured in maurices stores and every Finalist will be featured on the Contest Website. The dates of each 6-day period where Finalists will have their music featured in maurices stores are as follows:

First Finalist Band Voting Period February 6-12, 2012
Second Finalist Band Voting Period February 13-19, 2012
Third Finalist Band Voting Period February 20-26, 2012
Fourth Finalist Band Voting Period February 27, 2012-March 4, 2012

Members of the public can vote for a Finalist band by either (1) going to the Contest Website and following the instructions to cast a vote. Limit one (1) vote per person/e-mail address per day; or (2) visiting a maurices store and using a smart phone to scan the Quick Response (QR) Code located on signage for the Contest. The Finalist band that receives the highest number of votes during Round 3 will be determined the Grand Prize Winner. The remaining three (3) Finalist bands will be selected as the Runners-Up Prize Winners. In the event of a tie, the judges from Round 2 will review the Finalists songs and will choose the Grand Prize Winner or Runner-Up Prize Winner, whichever is applicable, on the basis of the same criteria used in Round 2. In the unlikely event that a tie remains after applying the Judging Criteria used in Round 2, the Finalist with the highest score in overall marketability will be declared the Grand Prize Winner or Runner-Up Prize Winner, whichever is applicable.

Any individual or group engaged in vote manipulation or fraudulent voting practices in violation of these Official Rules, including but not limited to the use of any robotic, automatic, mechanical, programmed or similar method to submit votes, may be in violation of criminal and civil laws and may be subject to legal action by Sponsor or its agents, and all votes submitted thereby will be disqualified. If Sponsor determines that a member of any Finalist band is involved in such prohibited activity, all of that bands votes shall be deemed void, and the band and all members of it will be disqualified from the Contest, and will not be eligible to receive a prize.

The decisions of the Sponsor and the judges are final and binding in all matters relating to this Contest. Each member of any potential winning band (Runner-Up or Grand Prize) must comply fully with these Official Rules in order to be eligible to win and receive the designated prize. Sponsor will attempt to contact each potential winning band member by telephone, mail and/or e-mail within approximately five (5) days after the conclusion of the Round 2 judging process, and each member (or if a minor, the members parent/legal guardian) will be required to complete, sign and return an Affidavit of Eligibility, Liability Release, and a Publicity Release, within a stated time period, or the prize will be forfeited and may be awarded to an alternate Finalist band with the next highest number of votes during Round 3, as explained above. The Grand Prize Winner will be notified by phone, email and/or postal mail within approximately seven (7) days following the conclusion of the Final Voting Period and the tabulation of all votes received.
5. Contest Prizes:

Grand Prize: The one (1) band chosen as the Grand Prize Winner will receive the following prize:

o Opportunity to perform a live daytime maurices Hometown Sound branded showcase at the 2012 SXSW event in Austin, Texas
o Opportunity to shoot a music video in Los Angeles

o For each band member, his/her choice of a $250.00 maurices Gift Card or $250.00 Visa Gift Card

Signed Artist gear including signed guitars, t-shirts and CDs. [
o Opportunity to have their music featured on maurices in-store music playlists and web radio player

Approximate Retail Value (ARV) of Grand Prize: $$55,800, plus the total value of the gift cards awarded to each band member . member. Any difference between the stated ARV and the actual value, if any, will not be awarded. The Grand Prize consists only of the items listed above. Any other expenses in connection with the acceptance or use of the prize will be the sole responsibility of the winning band. Sponsor assumes no responsibility for the allocation of the Grand Prize among the Grand Prize-winning bands members.
Runners-Up Prizes: The three (3) bands chosen as the Runners-Up will receive the following:

o For each band member, his/her choice of a $100.00 maurices Gift Card or $100.00 Visa Gift Card

o Signed Artist gear including signed guitars, t-shirts and CDs.

o Opportunity to have their music featured on maurices in-store music playlists and web radio player

ARV of each Runners-Up Prize: $1,000, plus the total value of the gift cards awarded to each band member.

Total ARV of all prizes in this Contest: $56,800, plus the total value of all gift cards awarded to the member of the prize winning bands.
Prizes may not be transferred, assigned, redeemed for cash or substituted, except that the Sponsor may substitute any prize or prize component with a prize or prize component of equal or greater value in the event the stated prize/component becomes unavailable. If a potential Finalist or the potential Grand Prize Winner cannot accept a prize as stated, the prize may be forfeited. All income taxes on the Prizes are the responsibility of the band members, and an IRS Form 1099 will be issued and filed on behalf of each member of the winning bands for his/her proportionate value of the Prize. All prizes will be awarded provided they are properly claimed in accordance with these Rules.
6. General Conditions: Participation in this Contest constitutes agreement by entrant to be bound by these Official Rules. By entering in Contest, entrant agrees to execute any documents and instruments and take any further acts as Sponsor may reasonably request in order to effectuate the terms and conditions of Contest. Sponsor reserves the right to disqualify any entrant if such entrant has engaged in or, during the Contest or in accepting and/or using a prize, engages in any act which, in Sponsor's sole judgment, involved moral turpitude or which brings Sponsor or entrant into public disrepute, contempt, scandal or ridicule, or which damages, denigrates or injures the reputation or success of Sponsor or its products or services. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Contest, except as expressly set forth in these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry or voting process, the web site, and/or the legitimate operation of the Contest; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.

WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, voting problems, or any other causes beyond the control of Sponsor, which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor may, in its sole discretion, void any suspect entries (or votes) and (a) modify the Contest or suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible, non-suspect entries received (and all votes received) up to the time of the impairment.

Limitations of Liability and Releases: BY PARTICIPATING IN THIS CONTEST, ENTRANT AGREES THAT SPONSOR AND ITS AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEB SITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE RELEASED PARTIES) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS CONTEST OR IN ANY CONTEST RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. BY SUBMITTING AN ENTRY, ENTRANT HEREBY GRANTS SPONSOR A ROYALTY-FREE, IRREVOCABLE, AND WORLDWIDE, IN PERPETUITY LICENSE TO USE THE SUBMISSION IN ANY FORM OR FORMAT AND TO MODIFY THE SAME FOR USE FOR ANY PURPOSE, AND ACKNOWLEDGES AND AGREES THAT IF SPONSOR DOES USE THE SUBMISSIONS ENTRANT SHALL NOT BE ENTITLED TO ANY CREDIT, CONSIDERATION, NOTICE OR PAYMENTS OF ANY KIND. ENTRANT WAIVES ANY MORAL RIGHTS HE OR SHE MAY HAVE TO THE SUBMISSIONS, AND AGREES THAT IF SPONSOR ELECTS TO USE SUBMISSIONS FOR ANY PURPOSE, ALL RIGHTS UNDER COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS WHICH MAY RESULT FROM SPONSORS ELECTED USE OF THE ENTRANT'S SUBMISSION BY SPONSOR SHALL BE THE SOLE PROPERTY OF SPONSOR. ENTRANT FURTHER AGREES THAT IF SPONSOR ELECTS TO USE ENTRANT'S SUBMISSIONS, ENTRANT WILL EXECUTE ANY DOCUMENTS REQUESTED BY SPONSOR REGARDING THIS LICENSE OR ASSIGNMENT. IF ANY USE BY SPONSOR OF THE SUBMISSIONS CAUSES IT TO BE LIABLE TO ANY THIRD PARTY, ENTRANT AGREES TO INDEMNIFY SPONSOR AND ITS AGENTS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES AND ALL RELATED PARTIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) WHICH IT INCURS AS A RESULT OF ITS USE OF THE SUBMISSIONS.

8. Nature of Relationship/Waiver of Equitable Relief: Each entrant understands and acknowledges that Sponsor has wide access to ideas, designs, and other materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each entrant also acknowledges that many ideas may be competitive with, similar or identical to the Submission and/or each other in theme, idea, format or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Sponsor's use of any such similar or identical material. Each entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of Sponsor actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Submission or any material based on or allegedly based on the Submission, and the entrant's rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law

9. Disputes: Except where prohibited by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for District of Minnesota or the appropriate Minnesota state court located in Minnesota; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws, regulations, and ordinances of Minnesota, without giving effect to any choice of law or conflict of laws rules (whether of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Minnesota.

10. Privacy: Information collected from entrants is subject to the Sponsors Privacy Policy, which may be found at http://www.maurices.com. Entrants agree that Sponsor and Sponsors agents, parent companies, affiliates, subsidiaries, representatives or service providers may use entrants personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest. Sponsor will not sell personal information submitted with entry to outside solicitors.
