Summary

The "Hottest New Artist" (HNA) song contest is open to US Citizens, residents and US military members serving overseas. Entries will be played on air on the Hottest New Artist Radio Show, Thursday nights at 8pm, streaming live at 1340WHAP.com (livestream/media/whapradio) and 1340AM on the radio dial. The show broadcasts to 70,500 listeners in the Richmond, VA area. Songs are also judged by industry music professionals and web polls.



Submissions will be screened on production quality, originality, song writing overall impact and radio readiness (edit out explicit lyrics; no re-mixes or samples). If selected as one of the 40 Semi-Finalist you must provide edited song within a few weeks of notification.



A three phase song battle is for emerging artist to submit original songs for the chance to become PDS Entertainment LLC (ASCAP) Top 20 & #1 HNA. Phase I includes 40 Semi finalists selected by virtue of their song then artist moves to Phase II and performs at Meeting of Artist (in person, or by video/conference – see rules).



The Top 20 & #1 Finalist receive publishing contract, compilation CD, promotion and are paid royalties with #1 artist offered complete album package. All 40 finalists will receive prizes that will be posted on website as their sponsors and partners development. The promoter plans on reviewing submissions within 30 days of submitting.

Terms And Conditions

Official Rules and Regulations:

1 1 to 3 Songs on CDR in a regular sized CD case with correct order of song title, track no., and minutes (under 4 min per song) noted along with entrant's name and phone number. Entry materials submitted will not be returned.

2 Entrant must be 18 years of Age and U.S. Citizen or permanent resident (group member ages 15-17 are allowed to enter however; main entrant must be 18 and be the contact for the group, also signatures of parents or guardians are required for under age members to participate).

3 All entries submitted must be original songs and shall not infringe any copyrights or any other rights of any third parties. Songs may have multiple co-writers, and they must be designated on the entry form. Entrant shall, by entering, indemnify and hold PDS harmless from and against any claims inconsistent with the foregoing.

4 HNA competition is open to US Citizens, residence, and military member serving oversea.

5 Entrant's responsibility to ensure songs submitted is complete and playable. PDS does not give feedback or a critique to entrants, but will post suggestions beneficial to the competition, also helpful tips, and FAQ. PDS is not responsible for late, lost, damaged, misdirected, postage due, stolen, or misappropriated entries.

6 Entries will be screened by PDS Entertainment, and industry entity in Phase 1 and judged on production quality, melody, composition, originality, lyrics, and overall vibe. It also must be radio ready where editing out of any explicit content, lyrics, and songs must be original material no re mixes or samples. 40 Semi-finalists will be selected then contacted and sent instruction to submit additional items within two weeks: CD master, BW and color photo, typed bio and lyric sheet and any consent form(s).

7 At Meeting of Artist, Phase II, takes place within 30 days following entry deadline.

The 40 Semi-Finalist will be required to attend meeting in person or by video conference, or may submit advance DVD performance of song. The meeting will take place in NYC, PA, GA or VA prior to meeting the 40 Simi-Finalist will be mailed time sensitive instruction that must be returned. Judging panel, public opinions polls and other critiques (at meeting) will be conducted on artist stage presence, musical and vocal performance to help decide the TOP 20, and #1 Hottest New Artist. PDS will use its best efforts to announce the winners at the designated time, and published results on website, but will not be held liable for any unforeseen delays. Winners will be notified by certified mail. Winners will be required to sign an affidavit confirming that winner's song is original and he/she holds rights to the song, publishing contract will also be included. Failure to sign and return the form within the required time period or provision of false information may result in disqualification and an alternate winner may be selected. Affidavits are subject to verification by PDS and its agents.

7. Prizes: The 40 finalists will receive certificate suitable for framing along with other prizes TBA (As our sponsors come on board website will be updated with prize and other information). Top 20 Artist will receive a single song record contact and a publishing contract from PDS Entertainment of VA LLC (ASCAP), song inclusion on commercial release CD that will be promoted and marketed to radio, be distributed and sold with artist paid standard royalties. Also 10 copies of the CD release will be sent to Top 20 and #1 artist.

All winners agree to release PDS and sponsors from all liability regarding prizes won. All federal, state, and local taxes, and customs fees, when applicable, are the sole responsibility of winner. PDS will not pay any winners' taxes. Prizes will be sent out within a reasonable amount of time, and PDS will use its best efforts to send prizes out in a timely fashion. Please note that prizes which are being sent to winners from Sponsors may take longer than prizes sent directly from PDS. If the winner has not received any portion of prizes within 180 days and has not responded to PDS communication, PDS will no longer be responsible for delivery of prizes.

8. Entrant constitutes permission to use winners name, likeness, and voice for future advertising and publicity purposes without additional compensation. Entrant agrees that should his/her song(s) be selected, PDS shall have the right to include the winning song(s) on the PDS Compilation CD to be used for promotional, marketing, distribution and sales. Top 20 Hot New Artist local TV, News, and radio will be sent press release, and finalist may be contacted to set up possible artist interviews. Entrant retains all ownership rights to all submitted song(s) until such time as record, and publishing contracts are in force. Contracts will include distribution percentages of royalties that will be paid to the artist.

9. Entrant acknowledges that all songs entered may be distributed to screeners, judges who will be selecting the winners, and Entrant agrees to release, indemnify, and hold PDS, its sponsors, and judges harmless for liability, method of use, damages, or claims for injury or loss to any person or property relating to, in whole or in part, directly or indirectly, participation in HNA.

10. By entering HNA, entrant and/or their parents or legal guardian (if such entrant is a minor) agree to accept and be bound by the decisions of PDS and its screeners, judges which are final and binding in all matters. Entrant agrees to be bound by all terms of these official PDS Rules and Regulations as established herein and by which PDS retains the right to make any necessary changes.

11. PDS/HNA shall not be responsible or liable for any loss or damage of any sort of incurred as the result of any dealings or the result of the presence of any third parties with which PDS has established a sponsorship or advertising relationship.
