Want to play KahBang Festival? After booking over 30 Sonicbids artists this year, KahBang has opened up 1 final slot for a Sonicbids artist – but this time they’re letting the fans get involved through Facebook voting. Submissions are FREE for all artists, courtesy of KahBang and Sonicbids.

HERE’S HOW IT WORKS:

After the entry period ends, all eligible bands will have a song (choose your best track to enter) included on the official KahBang or BUST contest page on KahBang’s Facebook page from June 29, 2012 through July 13, 2012. Your song will be promoted to thousands of visitors and the 10 artists with the most votes on Facebook will move on to the final judging round, where one band will be selected by KahBang’s music supervisors.

THE FOLLOWING CONTEST IS VALID ONLINE ONLY TO LEGAL RESIDENTS IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA. YOU MAY NOT SUBMIT AN ENTRY IN THE CONTEST UNLESS YOU ARE: 18 YEARS OF AGE OR OLDER (OR 19 IN ALABAMA OR THE APPLICABLE AGE OF MAJORITY IN YOUR JURISDICTION) AND YOU HAVE AN ACTIVE EMAIL ADDRESS AS OF MARCH 29, 2012 AND HAVE A REGISTERED SUPERSONIC ACCOUNT WITH SONICBIDS.COM. KahBang Festival, 555 Stillwater Ave. Bangor, ME 04401 ("KahBang") and Sonicbids, Corporation ("Sonicbids") 500 Harrison Ave Suite 404R Boston, MA 02118 (collectively "Sponsor") are offering this Contest ("Contest") which is being administered, powered and produced by Sonicbids.

1. Eligibility: This Contest is open only to legal U.S. Residents of the 50 United States and the District of Columbia, who are of the age of majority in their province or state as of the date of entry; who are performers or musicians who are in a band with an active e-mail address as of June 15, 2012 and a Sonicbids Account. If the entrant is younger than the age of majority in entrant's province or state, entrant's legal guardian must agree to these official rules and the terms of conditions relating to the website. The term "band" as used herein shall refer to a music group that: a) performs and writes their own music; and b) does not currently have exclusive recording arrangement with any recording label and/or administration arrangement with any third party publisher that would render the group incapable of granting the rights that an entrant, Semi-finalist, Finalist or the Grand Prize Winner is required to grant in accordance with these Official Rules. This Contest is void where prohibited by law and is subject to all applicable laws, including, without limitation, U.S. federal, state and local laws and regulations. Employees, officers and directors of Sponsors, their affiliates, subsidiaries, agents, retailers, distributors, wholesalers, and advertising and promotion agencies, and members of the immediate families (defined for these purposes as parents, spouse, children, siblings, grandparents, and each of their spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate. Proof of eligibility will be required.
2. Entrants: Contest begins June 15, 2012 and ends 11:59:59 pm ET on July 13, 2012 (the "Contest Period"). Limit one entry per band for the entire Contest Period. Only one member of a band may submit an entry on behalf of his/her band, but the names, ages and residency of all members of each band must be listed on the submitted entry form. Each entry submitted will be deemed submitted on behalf of all of the band members identified on the official entry form. By submitting an entry, the band member doing so represents and warrants that s/he has received permission to enter the Contest from each member of his/her band listed on the official entry form, and to submit each of their names and the recording of their performance that is included with the submitted entry. The terms "contestant" or "entrant" as used herein shall refer to each band in its entirety (and its individual members) and not to the person who actually submitted the entry on his/her band's behalf. Once an entry has been submitted, the band may not add or remove any members. To enter the Contest, register at www.sonicbids.com and follow the instructions at www.sonicbids.com/kahbangorbust to submit your completed entry form along with your Electronic Press Kit ("EPK"), which will include one (1) of your band's MP3 music files (maximum file size 5MB). All entries, including all material submitted with the entries shall be subject to the terms and conditions set forth in Section 8 herein as well as all other applicable provisions of these Official Rules and will not be returned. These Official Rules are intended, in part, to enable consumers to view and listen to your band's submitted song at www.kahbang.sonicbids.com and https://apps.facebook.com/kahbangorbust ("Contest Websites"), microsites hosted by the Sponsors and produced and powered by Sonicbids for voting purposes in connection with this Contest (see voting details in Rule 3, below). The entry form and all elements included with it, including your song, EPK and all other required material, constitute and will be referred to herein collectively as an ("EPK"), "entry." All contest entries must be received by 11:59:59 pm ET on June 27, 2012. Proof of submission of an entry will not be deemed proof of receipt by Sponsors or its agents. Entries must comply with all submission requirements and content restrictions described in Rule 8, below. Read all such requirements and restrictions carefully before you submit an entry. Participation in Contest online is subject to the Privacy Policy and Terms of Use at www.sonicbids.com. IF YOU DO NOT AGREE TO THE PRIVACY POLICY AND TERMS OF USE, DO NOT ENTER THE CONTEST, PROVIDE ANY PERSONAL INFORMATION ON THE WEBSITE OR OTHERWISE USE THE WEBSITE.
Selection of Winning Bands and Voting Round Finalists: A total of 1 registered Sonicbids artists from the 50 United States and District of Columbia from the eligible entries will win the opportunity (the "Winning Bands") to perform at the 2012 KahBang Festival ("KahBang"). The Winning Band will be selected based on one round of online public voting and one round of judging as set forth below.
Round 1: Public Voting: Beginning at or around 12:00:01pm ET on or around June 29, 2012 and ending at or around 11:59:59 pm ET on or around July 13, 2012 (the "Public Voting Period"), any person with a valid Facebook account who "Likes" the Official Kahbang Facebook page (http://www.facebook.com/kahbang) and the Official Sonicbids Facebook page (http://www.facebook.com/sonicbids), may access the voting sites (at https://apps.facebook.com/kahbang and/or http://kahbang.sonicbids.com) and vote on the Contest Websites for the entrant that is his/her favorite. Limit of one (1) vote per person/e-mail address per day. Voting will be subject to the terms of use of the Contest Website and to any additional voting/downloading instructions that may be posted on the Contest Websites. All votes must be received by 11:59:59 pm ET on July 13, 2012.
Following the conclusion of the Public Voting Period, all valid votes received by each band will be counted. The ten (10) bands that receive the highest number of valid votes will be declared "Finalists," and will be passed along to the Sponsors for Round 2: Judging by KahBang. In the event of a tie or dispute or for any other reason that Sponsors may deem necessary, the Finalist selection shall be made by KahBang, in its sole discretion, based on the Judging Criteria.
Round 2: Judging by KahBang: Beginning on or about July 13, 2012, representatives from KahBang will review the 10 Finalists. The judges will select one (1) of those Finalists as Winning Bands to perform at the 2012 Kahbang Festival (subject to verification of eligibility and compliance with these Official Rules). Eligible entries will be judged based on the following equally weighted criteria: originality (20%), creativity (20%) and most compelling (60%) (the "Judging Criteria").
Sponsors reserve the right to not select any Finalists or winners if Sponsors determine in their sole and absolute discretion that the entries did not meet the minimum qualification standard based on the Judging Criteria. To the extent permitted by law, Sponsor disclaims any liability from, and registrants and entrants, whether or not a Finalist or winner, agree to waive, any claims against, Sponsor and their respective representatives and affiliates relating to the judging or awarding process.
Any individual or group engaged in vote manipulation or fraudulent voting practices in violation of these Official Rules, including but not limited to the use of any robotic, automatic, mechanical, programmed or similar method to submit votes, may be in violation of criminal and civil laws and may be subject to legal action by Sponsor or its agents, and all votes submitted thereby will be disqualified. If Sponsor determines that a member of any band that is an entrant in the Contest is involved in such prohibited activity, all of that band's votes shall be deemed void, and the band and all members of it will be disqualified from the Contest and will not be eligible to receive a prize.
WARNING: ANY ATTEMPT BY ANY PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsors are not responsible for: (i) electronic transmissions/entries/votes that are lost, late, stolen, incomplete, illegible, damages, garbled, destroyed, misdirected or not received by Sponsors for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsors' reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest, or (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified. All incomplete or non-conforming entries will be disqualified. If for any reason this Contest cannot be executed as planned, included but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors' that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsors reserve the right to terminate this Contest. If the Contest is terminated before the original end date, Sponsors reserve the right in its discretion to select, along with the panel of judges, the Winning Bands on the basis of the Round 2 judging criteria from among those eligible, non-suspect entries already received as of the termination time/date. Sponsors reserve the right at their sole discretion to disqualify any entrant it finds to be tampering with or attempting to tamper with the entry/voting process or the general operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or entrant.
3. Contest Prizes:
Winning Band: Winning band selected by the Sponsors as set forth above to perform Kahbang will receive a performance slot, camping accommodations and their bio included on the "artist" section of the Official KahBang website. Approximate Retail Value ("ARV"): $120 Odds of winning depend upon the number of eligible entries received.
The Prize Fee consists only of the items listed above. Any other expenses, including without limitation, flights, accommodations, backline equipment or any other needs, in connection with the acceptance or use of the prizes will be the sole responsibility of each Winning Band.
Prizes may not be transferred, assigned, redeemed for cash or substituted, except that the Sponsors may substitute any prize or prize component with a prize or prize component of equal or greater value in the event the stated prize/component becomes unavailable. If a potential prize winner cannot accept a prize as stated, the prize may be forfeited. All income taxes on the prizes are the responsibility of the band members, and an IRS Form 1099 will be issued and filed on behalf of each member of the Winning Bands for his/her proportionate value of the prize. All prizes will be awarded provided they are properly claimed in accordance with these Rules.
The decisions of the Sponsors and the judges are final and binding in all matters relating to this Contest. Each member of any potential winning band must comply fully with these Official Rules in order to be eligible to win and receive the designated prize. Sponsors will attempt to contact each such band member by telephone, mail and/or e-mail within approximately five (5) days after the conclusion of the Round 2 judging process.
4. Warranties and Indemnification: By accepting the Prize Fee, each member of the Winning Band consents to the use of his/her name, voice and/or likeness for advertising, public relations or trade purposes in connection with the Contest in any media worldwide and in any manner, now or hereafter known, without limitation or additional notice or compensation. Entrants agree to abide by the terms of these Official Rules, and by decisions of the judges. By entering, entrants agree to defend, indemnify, release and hold harmless the Sponsors, the judges, and each of their respective parent companies, directors, officers, employees and agents from and against any and all liability arising from or in connection with the Contest, or resulting from the acceptance and/or use of any prize they may be awarded or their participation in this Contest, or at KahBang, or from any misuse, or malfunction of any prize awarded, including without limitation personal injury, death, and/or property damage.
5. Ownership/Use of Entries: Entrants retain ownership of the compositions and sound recordings they submit; however, by entering the Contest, each band member grants Sponsor a fully-paid, irrevocable, non-exclusive, perpetual right and license to (a) publish, distribute, use, edit, display, reproduce, prepare derivate works of, distribute, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world any or all of the content in your initial entry, including without limitation all musical and lyrical compositions and sound recordings, in any manner, form or format now known or hereinafter created, including on the internet without payment or further notice to or approval from the entrant without territorial, time, or other limitations, for any and all purposes in connection with the Contest or the goodwill of Sponsors, including, but not limited to, marketing, advertising, and promotional purposes; (b) use your name, image, likeness,, artist/band name, names of participating band members and each of their respective images and likenesses for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes; and (c) record and produce media content, as a work made for hire for Axis, including, but not limited to, audio, video, and photographic images, of the performing band and each member thereof at, for, or during official Contest events, which materials may be exploited by Axis or its designees in any manner or media, now known or hereafter devised, in connection with KahBang other event projects., in any manner it deems appropriate. Entrants further agree that all licenses and rights granted under this section are on a gratis basis. Entrant represents and warrants that he or she has the authority to enter into and fully perform this Agreement and that by entering into and fully performing under this Agreement, entrant is not in conflict with any prior obligations to third parties or does not violate or infringe upon the rights of any third parties.
6. Further Entry Requirements and Content Restrictions: All entries must comply in all respects with the following requirements and content restrictions: Entry cannot be sexually explicit or suggestive or derogatory of any ethnic, racial, gender or religious group; Entry cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), Entry cannot be obscene or offensive, in the opinion of the Sponsor, and cannot endorse any form of hate or hate group; Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies; Entry cannot contain copyrighted materials owned by others without permission of the owner(s); and Entry cannot communicate messages inconsistent with the positive messages and/or goodwill to which Sponsor wishes to associate. The right to submit or use an Entry must not be restricted in any way. By submitting an Entry you warrant and represent that: (a) it is your band's original work and all lyrics and production are owned by your band, (b) it has not been previously published, (c) it has not won previous awards, (d) it does not infringe upon the rights of any person or entity; and (d) Sponsor's use of the entry in any manner permitted hereunder will not infringe on any third- party rights. Entrants agree to defend, indemnify and hold harmless, Sponsor from and against any claims to the contrary. Modifying, enhancing or altering a third party's preexisting work does not qualify as entrant's original creation and will subject the entrant to disqualification. Cover songs or samples are not permitted for entry or to be played live in any performances associated with this contest. Please note: Entries containing covers of copyrighted songs or songs containing samples will be disqualified and the corresponding band and each of its members shall be ineligible for participation in this Contest. If an entry does not conform to Contest requirements and all of these Official Rules in whole or in part, the entry and the band that submitted it will be disqualified.
7. Certain Prizes: For any prize awarded hereunder that involves a ticket, pass, back stage pass, VIP pass, access to a venue or access to an entertainer or entertainer group (collectively, a "ticket"), the ticket shall be a revocable license to the specific event and location within the venue and for the time indicated to the prize winner by the Sponsors. The Sponsors reserve the right, without the award of any substitute prize or payment of any cash equivalent value, to refuse admission or to eject any person who fails to comply with the rules of the KahBang Festival. No exchanges. The ticket user assumes all risks of personal injury incidental to the event, whether occurring prior to, during, or subsequent to KahBang, and holder voluntarily agrees that the Sponsors, promoters, venue/facility, league or team, artist(s) performing, participants, participating clubs, and all of their respective agents, officers, directors, owners and employees are expressly released from any claims arising from such causes. The prize winner/user bears all risks of inclement weather. Tickets lost or stolen cannot be replaced. Event time and date is subject to change. The resale or attempted resale of a ticket is prohibited and if discovered will result in the ticket being voided without the award of any substitute prize, exchange or payment of any cash equivalent value. The ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade purposes without the express written consent of the Sponsors.
8. Participation in this Contest constitutes each entrant's full and unconditional agreement to and acceptance of these Official Rules: By entering, entrants further agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants' rights and obligations, or the rights and obligations of the Sponsor in connection with this Contest, will be governed by, and construed in accordance with, the laws of the State of Massachusetts, without giving effect to any choice of law or conflict of law rules. By participating in this Contest, entrants agree that the state and federal courts located in the Commonwealth of Massachusetts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Contest, or, at the election of Sponsors, any dispute or claim of any kind will be resolved by binding arbitration, such arbitration to be held in Boston, Massachusetts, and shall be held in accordance with the rules of the American Arbitration Association. Each entrant further agrees to release, indemnify and hold the Sponsors, and their respective parent companies, affiliates, subsidiaries and promotion and advertising agencies, and the officers, directors and employees of each of the foregoing, harmless from and against any liability whatsoever for any claims or causes of action related to any asserted injuries, losses, or damages of any kind to persons or property, including without limitation copyright infringement, death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of the any prize that may be awarded, or participation in this Contest (including without limitation the submission of an entry) or participation in any Contest-related activities. As a condition of entering, each entrant agrees that: (a) under no circumstances will such entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (b) any all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees. Sponsors reserve the right to take such action, as they deem necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules.

Contest Winners/Official Rules: For the names of the Finalists and Winners and/or to receive a copy of these Official Rules, see the Contest website or send a self-addressed, stamped #10 business-size envelope, to be received by August 15, 2012 to 500 Harrison Ave, 404R Boston, MA 02118. Specify "winners list" or "rules" on your request. WA and VT residents may omit return postage.
