The 12 Finalists

Twelve finalists will be chosen by celebrity judges to compete at one of three live events across the country and will receive:

  • $500 travel stipend
  • 1-year Rhapsody To Go Subscriptions for your entire band

Here’s How it Works

Round 1: Bands have from June 5 – July 1 to join the competition by submitting their Electronic Press Kit (EPK). Band will choose whether they would want to perform in Chicago, Nashville or Austin should they be chosen as Finalists. All submitting bands who meet Land Shark Lager’s eligibility criteria will be entered into voting. Starting approximately July 16th, bands try to generate as many votes as possible on the Land Shark BOTB hub, which will feature your band's photo, bio and favorite tune. Bands can spread the word everywhere: via their website at their gigs, radio interviews and more. At the end of that period, the 60 bands with the most votes (20 bands from each location) will move on to the next round.



Round 2: A panel of music executives from Rhapsody and representatives from Land Shark will choose their 4 favorite bands from each market (Chicago, Austin and Nashville) to compete in the semi-finals (Round 3). The top 12 finalists will be announced on or around August 28.



Round 3: The competition heats up as the top 12 bands compete at one of three live events across the country:


  • Chicago, IL: Sept. 17, 2009
  • Nashville, TN: Sept 24, 2009
  • Austin, TX: October 9, 2009


Round 4: We’ll film your entire set at the live event. A video of your best performance will be featured on the Land Shark BOTB hub. From approximately October 23 – November 23, fans will vote on their favorite act. The band with the most votes from among all the bands that competed in Round 3 will be announced the winner!

YOU MAY NOT SUBMIT AN ENTRY IN THE CONTEST UNLESS YOU ARE: 21 YEARS OF AGE OR OLDER; A LEGAL RESIDENT OF ONE OF THE 50 UNITED STATES (EXCEPT CA) OR D.C.; IN A BAND AT TIME OF ENTRY; AND YOU HAVE AN ACTIVE EMAIL ADDRESS AS OF 6/5/09. 1. This Contest is open to legal U.S. residents of the 50 United States (except CA) and the District of Columbia, who are in a band and are 21 years of age or older at time of entry with an active e-mail address as of 6/5/09. The term band as used herein shall refer to a music group that: a) performs music; b) has a minimum of 2 performers; and c) does not currently have an exclusive recording arrangement with any recording label that would render the group incapable of granting the rights that an entrant, Semi-finalist, Finalist or the Grand Prize Winner is required to grant in accordance with these Official Rules. This Contest is void in California, outside the remaining United States and D.C. and where prohibited. Employees, offices and directors of Sponsor, its affiliates, subsidiaries, agents, retailers, distributors, wholesalers, and advertising and promotion agencies, and members of the immediate families (defined for these purposes as parents, spouse, children, siblings, grandparents, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate. Proof of eligibility will be required.

2. Contest begins at 12:01:01 am Eastern Time (ET) on 6/5/09 and ends at 11:59:59 pm ET on 7/1/09 (the Contest Period). Limit one entry per band for the entire Contest period. Only one member of a band may submit an entry on behalf of his/her band, but the names of all members of each band must be listed on the submitted entry form. Each entry submitted will be deemed submitted on behalf of all of the Band Members identified on the official entry form. By submitting an entry, the band member doing so represents and warrants that s/he has received permission to enter the Contest from each member of his/her band listed on the official entry form, and to submit each of their names and the recording(s) of their performance(s) that are included with the submitted entry. The terms contestant or entrant as used herein shall refer to each band in its entirety and not to the person who actually submitted the entry on his/her bands behalf. Once an entry has been submitted, the band may not add or remove any members. To enter the Contest, follow the instructions at www.sonicbids.com/landsharklagerbattle to submit your completed entry form along with your Electronic Press Kit (EPK), which will include at least one (1) but no more than ten (10) of your bands MP3 music files (maximum file size 5MB). All entries, including all material submitted with the entries shall be subject to the terms and conditions set forth in Section 8 herein as well as all other applicable provisions of these Official Rules and will not be returned. These Official Rules are intended, in part, to enable consumers to view and listen to your bands submitted song(s)/performance(s) at www.landsharkrocks.com (Contest Website), a microsite hosted by the Sponsor and produced and powered by Sonicbids, Corporation (Sonicbids) for voting purposes in connection with this Contest (see voting details in Rule 3, below) and to download one of your songs if your band is chosen as a Finalist in this Contest (see Finalist selection details in Rule 3, below). The entry form and all elements included with it, including your song(s), EPK and all other required material, constitute and will be referred to herein collectively as an (EPK), entry. Among the other required information, your entry must indicate which of the following cities your band would like to perform in if the band is chosen as a Finalist in this Contest: Chicago, IL, Nashville, TN or Austin, TX, (each a Performance City). Please note that once you make a choice of cities, you cannot change it. All Contest entries must be received by 11:59:59 pm ET on 7/1/09. Proof of submission of an entry will not be deemed proof of receipt by Sponsor or its agents. Entries must comply with all submission requirements and content restrictions described in Rule 9, below. Read all such requirements and restrictions carefully before you submit an entry.

3. Selection of Semi-Finalists, Finalists and Grand Prize Winner. A total of sixty (60) Semi-Finalists (twenty (20) per Performance city), twelve (12) Finalists (four (4) per Performance city) and one (1) overall Grand Prize Winner will be chosen in a four-round process as follows:
Round 1: Initial Public Voting. Beginning at 12:00:01 am ET on 7/16/09 and ending at 11:59:59 pm ET on 8/10/09 (the Initial Voting Period), any person who is 21 years of age or older and a legal resident of one of the 50 United States (except CA) or District of Columbia may access www.landsharkrocks.com and vote for one (1) entry posted on the Website that is his/her favorite. Limit one (1) vote per person/ e-mail address per day. Voting will be subject to the terms of use of the Contest Website and to any additional voting instructions that may be posted on the Contest Website. All votes must be received by 11:59:59 pm ET on 8/10/09.

Any individual or group engaged in vote manipulation or fraudulent voting practices in violation of these Official Rules, including but not limited to the use of any robotic, automatic, mechanical, programmed or similar method to submit votes, may be in violation of criminal and civil laws and may be subject to legal action by Sponsor or its agents, and all votes submitted thereby will be disqualified. If Sponsor determines that a member of any band that is an entrant in the Contest is involved in such prohibited activity, all of that bands votes shall be deemed void, and the band and all members of it will be disqualified from the Contest and will not be eligible to receive a prize. WARNING: ANY ATTEMPT BY ANY PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Following the conclusion of the Initial Public Voting Period, all valid votes received by each band will be counted. The twenty (20) bands that receive the highest number of valid votes per Performance City will be declared Semi-Finalists, and will advance to Round 2 of the selection process, as described below. In the event of a tie, all tied bands will proceed to Round 2 as Semi-Finalists.

Round 2: Judging by Music Industry Professionals. Beginning on or about 8/12/09, a panel of qualified judges including but not limited to music industry professionals from Rhapsody will review each of the bands selected as a Semi-Finalist. The judges will evaluate the bands based on the following criteria to determine four (4) Finalists per Performance City: originality (25%); the bands professionalism of recording (25%); composition of the bands lyrical content (25%); and the bands overall marketability (25%). The Finalists selected through the judging in Round 2 will be announced on or about 8/28/09, and each Finalist will be notified by mail, email and/or telephone. All Finalists will advance to Round 3, described below. All decisions of the judges are final. In the event of a tie, the band with the highest score in overall marketability will be declared the Finalist.

Round 3: Performance by Finalists. Each of the Finalists will be required to perform in the appropriate Performance City on the indicated date at a venue to be determined, as follows: Chicago: 9/17/09; Nashville: 9/24/09; and Austin: 10/9/09. Potential Finalists will be notified of the Performance Venue prior to the Performance. All Finalists must be able to travel to the appropriate Performance City to perform on the dates noted above or they will be disqualified and an alternate Finalist will be chosen (time permitting) based on the results of the Round 2 judging. All members of each Finalist band must be present at the performance or the Finalist band may be disqualified and rendered ineligible to perform or to receive a prize. Finalists will each perform four (4) songs, one of which must be a song that the band entered in its EPK. When all performances have been completed, the judges from Round 2 will select the one (1) song from among the songs performed by each Finalist band that they determine to be worthy of proceeding to the final round of the selection process. The portion of each Finalists recorded and filmed/taped performance in which they perform the selected song will be posted on the Contest website for final voting and selection of the one (1) Grand Prize Winner in Round 4, as described below.

Round 4: Final Public Voting. Beginning on or about 10/23/09 at 12:00:01 am ET and ending on or about 11/23/09 at 11:59:59 pm ET (the Final Voting Period), any person who meets the eligibility requirements for voting set forth above may access the Contest website, view all posted performances by all twelve (12) Finalist bands, and vote for the one (1) Finalist band that s/he feels deserves to be the Grand prize Winner of the Contest. Limit one (1) vote per person/ e-mail address for the entire Final Voting Period. Voting will be subject to the terms of use of the Contest Website and to any additional voting instructions that may be posted on the Contest Website. All votes must be received by 11:59:59 pm ET on 11/23/09. Each voter will receive the opportunity to download free of charge the song performed by the band for which s/he voted. Downloads are limited to one (1) per person/email address. Complete details will be provided to the voter on the Contest website upon completion of voting. In the event of a tie, the judges from Round 2 will review the Finalists posted performances and will choose the Grand Prize Winner on the basis of the same criteria used in Round 2. In the unlikely event that a tie remains after applying the Round 2 criteria, the Finalist with the highest score in overall marketability will be declared the Grand Prize Winner.

Following the conclusion of the Final Voting Period, all valid votes received by each Finalist band will be counted, and the band that received the highest number of valid votes will be declared the Grand Prize Winner (subject to verification of eligibility and compliance with these Official Rules).

4. Sponsor is not responsible for: (i) electronic transmissions/entries/votes that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants or any persons computer and/or its contents, or causes beyond Sponsors reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest, or (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified. All incomplete or non-conforming entries will be disqualified. If for any reason this Contest cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate this Contest. If the Contest is terminated before the original end date, Sponsor reserves the right to select, along with the panel of judges, Grand Prize Winner on the basis of the Round 2 judging criteria from among those eligible, non-suspect entries already received as of the termination time/date. Sponsor reserves the right at its sole discretion to disqualify any entrant it finds to be tampering with or attempting to tamper with the entry/voting process or the general operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or entrant.

5. Contest Prizes: Finalists: Each band chosen as a Finalist will receive a $500 travel stipend that may be used to travel to the Performance City for participation in Round 3, and a 1-year Rhapsody To Go Subscription for each member of the Finalist band. Approximate Retail Value (ARV): $1,220.00 per Finalist prize. The Finalist prize consists only of the items listed above. Any other expenses in connection with the acceptance or use of the prize, including but not limited to lodging and meals, will be the sole responsibility of each Finalist band
Grand Prize Winner: The One (1) band chosen as the Grand Prize Winner will receive the following prize package:

ARV of Grand Prize package: $100,000.00. Any difference between the stated ARV and the actual value, if any, will not be awarded. The Grand Prize consists only of the items listed above. Any other expenses in connection with the acceptance or use of the prize will be the sole responsibility of the winning band. Sponsor assumes no responsibility for the allocation of the Grand Prize among the Grand Prize-winning bands members.

Total ARV of all prizes in this Contest: $114,640.00.

Prizes may not be transferred, assigned, redeemed for cash or substituted, except that the Sponsor may substitute any prize or prize component with a prize or prize component of equal or greater value in the event the stated prize/component becomes unavailable. If a potential Finalist or the potential Grand Prize Winner cannot accept a prize as stated, the prize may be forfeited. All income taxes on the Prizes are the responsibility of the band members, and an IRS Form 1099 will be issued and filed on behalf of each member of the winning bands for his/her proportionate value of the Prize. All prizes will be awarded provided they are properly claimed in accordance with these Rules.

6. The decisions of the Sponsor and the judges are final and binding in all matters relating to this Contest. Each member of any potential winning band (Finalist or Grand Prize) must comply fully with these Official Rules in order to be eligible to win and receive the designated prize. Sponsor will attempt to contact each such Finalist band member by telephone, mail and/or e-mail within approximately ten (10) days after the conclusion of the Round 2 judging process, and each member will be required to complete, sign and return an Affidavit of Eligibility, Liability Release, and, except for TN residents, a Publicity Release, within a stated time period, or the prize will be forfeited and may be awarded to an alternate Finalist band as explained above. The Grand Prize Winner will be notified by phone, email and/or postal mail within approximately seven (7) days following the conclusion of the Final Voting Period and the tabulation of all votes received.

7. By accepting the Grand Prize, each member of the winning band consents to the use of his/her name and/or likeness for advertising, public relations or trade purposes in connection with the Contest in any media worldwide without limitation or additional notice or compensation (such consent being optional for Tennessee residents). Entrants agree to abide by the terms of these Official Rules, and by decisions of the judges. By entering, entrants agree to indemnify, release and hold harmless the Sponsor, the judges and David Kessler & Associates, Inc., and each of their respective parent companies, directors, officers, employees and agents from and against any and all liability arising from or in connection with the Contest, or resulting from the acceptance and/or use of any prize they may be awarded or their participation in this Contest, or from any misuse, or malfunction of any prize awarded, including without limitation personal injury, death, and/or property damage.

8. Ownership/Use of Entries: Entrants retain ownership of the compositions and sound recordings they submit; however, by entering the Contest, each band member grants Sponsor a fully-paid, irrevocable, non-exclusive right and license through December 31, 2010 to (a) publish, use, edit, display, reproduce, prepare derivate works of, distribute, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world any or all of the content in your initial entry and your performances (if selected to perform) at, for, or during official Contest events, including without limitation all musical and lyrical compositions and sound recordings, in any manner, form or format now known or hereinafter created, including on the internet without payment or further notice to or approval from the entrant without territorial, time, or other limitations, for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes; (b) use your name, image, likeness,, artist/band name, names of participating band members and each of their respective images and likenesses for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes; and (c) record and produce media content, including, but not limited to, audio, video, and photographic images, of the performing band and each member thereof at, for, or during official Contest events. Entrants further agree that all licenses and rights granted under this section are on a gratis basis. Entrant represents and warrants that he or she has the authority to enter into and fully perform this Agreement and that by entering into and fully performing under this Agreement, Entrant is not in conflict with any prior obligations to third parties or does not violate or infringe upon the rights of any third parties.

9. Further Entry Requirements and Content Restrictions: All entries must comply in all respects with the following requirements and content restrictions: Entry cannot be sexually explicit or suggestive or derogatory of any ethnic, racial, gender or religious group; Entry cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), Entry cannot be obscene or offensive, in the opinion of the Sponsor, and cannot endorse any form of hate or hate group; Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies; Entry cannot contain copyrighted materials owned by others without permission of the owner(s); and Entry cannot communicate messages inconsistent with the positive messages and/or goodwill to which Sponsor wishes to associate. The right to submit or use an Entry must not be restricted in any way. By submitting an Entry you warrant and represent that: (a) it is your bands original work and all lyrics and production are owned by your band, (b) it has not been previously published, (c) it has not won previous awards, (d) it does not infringe upon the rights of any person or entity; and (d) Sponsors use of the entry in any manner permitted hereunder will not infringe on any third- party rights. Entrants agree to indemnify and hold harmless, Sponsor from and against any claims to the contrary. Modifying, enhancing or altering a third partys preexisting work does not qualify as entrants original creation and will subject the entrant to disqualification. Cover songs or samples are not permitted. Please note: Entries containing covers of copyrighted songs or songs containing samples will be disqualified and the corresponding band and each of its members shall be ineligible for participation in this Contest. If an entry does not conform to Contest requirements and all of these Official Rules in whole or in part, the entry and the band that submitted it will be disqualified.

10. Participation in this Contest constitutes each entrant's full and unconditional agreement to and acceptance of these Official Rules. By entering, entrants further agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with this Contest, will be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules. Each entrant further agrees to release, indemnify and hold the Sponsor, Sonicbids, RealNetworks, Rhapsody, the judges and Rolling Stone, and their respective parent companies, affiliates, subsidiaries and promotion and advertising agencies, and the officers, directors and employees of each of the foregoing, harmless from and against any liability whatsoever for any claims or causes of action related to any asserted injuries, losses, or damages of any kind to persons or property, including without limitation copyright infringement, death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of the any prize that may be awarded, or participation in this Contest (including without limitation the submission of an entry) or participation in any Contest-related activities. As a condition of entering, each entrant agrees that: (a) under no circumstances will such entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (b) any all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys fees. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state, and local courts located in Missouri.
