Mamba® is giving you the opportunity to enter for a chance to win a showcase spot with Live Nation® at the House of Blues in Chicago!

In order to submit, you must be a Supersonic member of Sonicbids and have a video in the Video Section of your EPK. If you are selected to compete in the Battle of the Bands Contest, your video will be featured on the Mamba contest page where fans will vote for their favorite videos. Submit your video NOW and make sure to rally your fan base and get those votes in!

Terms And Conditions


1. Eligibility
Mamba Battle of the Bands Contest (the Contest) is open only to legal residents of the 50 United States and the District of Columbia who are eighteen (18) years or older at the time of entry that are not signed to a professional recording contract. Void where prohibited by law. Employees of Storck USA, L.P., Straticom Group Ltd., Live Nation Worldwide, Inc. or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution or distribution of the Contest and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrants full and unconditional agreement to these Official Rules and Sponsors and Administrators decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor and Administrator

3. Contest Period
The Contest begins on August 1, 2012 at 12:00 a.m. Eastern Time (ET) and ends on September 15, 2012 at 11:59 p.m. ET (the Contest Period). Sponsor is the official time keeper for this Contest.

4. How to Enter
During the Contest Period you can enter through the Mamba Battle of the Bands Contest tab on the Mamba Facebook Page ( (the Site). In order to access the Contest tab, you must first like the Mamba Facebook Page.

Then you must provide the following details on the entry form: band name, bands main contacts first and last name, main contacts email address, street address and phone number (Bands Main Contact), submission name (song name),. Additionally you must state how many individuals are in the band and list them by first and last name. Finally, you must upload a video of your band playing an original song (the Video). All materials submitted by an entrant are collectively known as the entry (the Entry). Each Video must be an entirely original song - no cover songs are permitted.

Entry Limits
All individuals in the band must meet the eligibility requirements stated above in Section 1.
An individual may be a member of more than one band.
Each band may only submit one Video / Entry.

Video Requirement
The Video may not exceed five (5) minutes in length and must meet the following formatting requirements: asf, asx, avi, divx, dv, dvx, m4v, mov, mp4, mpeg, mpg, qt, wmv, 3g2, 3gp, 3ivx, 3vx.

In addition to the foregoing requirements, Video may not contain, and Sponsor, in its sole discretion, may disqualify and/or remove any Video that contains, any content that:
Is sexually explicit or suggestive; obscene or offensive; derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
Promotes any particular political agenda or message;
Defames or disparages Sponsor or its parent or related entities;
Contains any copyrighted materials owned by others (including but not limited to songs, music, photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) or features or references trademarks, slogans or logos owned by others;
Violates any law or regulation; or
Is otherwise inappropriate, objectionable, or unsuitable for the uses contemplated in these Official Rules, as determined by Sponsor in its sole discretion.

Sponsor makes the final determination as to which Entries are eligible to take part in this Contest. Approximately 24 hours after the Video is uploaded it may be posted on the Site.

General Submission Conditions
Use of any automated system to participate is prohibited and will result in disqualification. Sponsor and Administrator are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entries which will be disqualified. All Entries become the sole and exclusive property of Sponsor and will not be returned.

5. Terms of Submission
By entering, you (all members of the band) represent and warrant that (i) the entire Video is an original work by you and you have not copied or used other works in your Video without permission or right to do so; (ii) no person, other than you have any right, title or interest in any part of your Video; (iii) your Video will not infringe or violate any rights of any third party or entity, including, without limitation, trade secret, copyright and trademark, defamation, privacy and publicity, false light, idea misappropriation or any contractual rights; (iv) you have all the rights, licenses, permissions and consents, including any rights of the Videographer or any other person that assisted in the creation of the Video, necessary to submit the Video in accordance with these Official Rules,. Sponsor reserves the right to disqualify, remove or, refuse to post any Video at any time for any reason at its sole discretion.


6. Voting
The Videos will be posted on the Site during the Contest Period. Individuals will be able to vote for the Videos which are their favorites. An individual is able to vote for as many different Videos as he wants per day, but is only able to vote for a particular Video once per day. Any attempt to circumvent this limit or use of an automated voting process will subject all votes from the individual to disqualification. Use of an automated process or similar device to vote is strictly prohibited. If a Video receives multiple and/or irregular votes from the same individual or individuals, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source, the Sponsor and/or Administrator may disqualify the Entry in their sole discretion.

If the voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, the Sponsor and/or Administrator in their sole discretion reserve the right to use another means to determine what prize, if any, a particular Entry should receive (i.e. by appointing a panel of judges). Entrants may not pay or provide any other type of consideration in exchange for votes. Any entrant who violates the ban on paying or providing consideration in exchange for votes will have his Entry disqualified.

The number of votes each Video has may be displayed on the Site, on a real-time basis, before being verified for integrity. These not yet verified votes do not necessarily accurately reflect the number of votes a particular entrant has received.


8. Determination and Verification Winners
The grand prize winner will be the band that has the most votes. The second prize winners will be the three bands that have next most votes. And the third prize winners will be the three bands that have next most votes. If there is a tie between two or more bands for a given spot, the winner will be determined by judging all the tied entries on the following three criteria: 1) creativity; 2) originality; and 3) showmanship (overall performance). The judging will be performed by the Sponsor, Live Nation and Administrator in their sole discretion. The band that scores the highest will win the prize. The potential winning band must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winners will be notified by email and/or telephone to the Bands Main Contact, on or about October 1, 2012. Each band member will be required to sign and return to Sponsor within five (5) days of the date notice is sent, an affidavit of eligibility, copyright license and liability/publicity release (except where prohibited) in order to claim his/her prize. If the Bands Main Contact cannot be contacted, or each band member fails to sign and return the affidavit of eligibility, copyright license and liability/publicity release within the required time period or if the notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner from among all remaining eligible entries based on which band next had the most votes.

9. Prizes

One (1) Grand Prize will be awarded. Grand Prize consists of five (5) wristbands for 1 (one) winner and four (4) guests and an opportunity to perform as an opening act for a select concert at House of Blues in Chicago, IL prior to December 1, 2012; round-trip, coach class air transportation for five (5) (from the airport nearest home of Bands Main Contact) within the l U.S. to Chicago, IL; two (2) double occupancy standard hotel rooms for two (2) nights / three (3) days; a $200.00 cash gift card; a Pacific Drums & Percussion - concept Series Birch drum set (details below); and Chop Shop Series Bossman - Bossman II (matte black finish) (details below). Approximate Retail Value of the Grand Prize is Eight Thousand, Fifty Dollars and No Cents ($8,050.00), depending upon point of travel origin and airfare fluctuations at the time of taking the trip. Any difference between stated approximate retail value and actual value of prize will not be awarded. Each band member must abide by all venue policies. On-stage performance prize will not be awarded to anyone who Live Nation and/or venue personnel deem to be intoxicated and may be a safety risk. On-stage performance time at sole discretion of Live Nation. Each band member may be required to sign an additional release of liability to participate in the on-stage performance prize. Selection of airline, hotel and concert seat location are solely within Live Nation discretion. All travelers must be in the band and appear in the winning Video. If the band has less than five members, only those members of the band will be able to go to Chicago. No non-band members will be able to go and no additional compensation will be provided if less than five individuals go on the trip. All other expenses not specifically mentioned herein are solely the band members responsibility. Band members will be required to provide a credit card to hotel to cover incidentals which are not included in prize package. Live Nation reserves the right to provide ground transportation in lieu of air transportation if the winner resides within two hundred (200) miles from Chicago, IL. Travel must take place on the day prior to the confirmed concert and return the day following the concert. All travel must be taken on dates specified; no alternative travel dates are available or prize will be forfeited and may be awarded to an alternate who next had the most amount of votes. All travel subject to availability and restrictions. Each band member must travel on same itinerary. Each band member must have all necessary identification and/or travel documents (e.g., a valid U.S. drivers license) required for travel. Band members understand that there are inherent risks involved in travel and that these risks may be present before, during and after the trip.

The details of the guitar in Grand Prize package are as follows: The Bossman II has a Mahogany body & neck, Rosewood fretboard with custom 'brass knuckle' pearl inlays. It has a 'Rat Rod' satin black finish, parchment color binding on the body & neck, chrome hardware including Wilkinson die cast tuners, and a bone nut. It includes two humbucker pickups, in which the neck pick up has a moderate output while the bridge pick up is hotter. It also includes a hard shell case.

One (1) second prize winner will receive a Pacific Drums & Percussion - concept Series Birch drum set (details below); and Chop Shop Series Bossman - Bossman II (white black finish) (details below). Approximate retail value of each prize is $1,800. The prize will be awarded directly to the person listed as the main contact on the Entry.
The details of the guitar for second prize package are as follows: The white Coupe de Ville series Bossman's bright white lacquer body, neck, and headstock combined with the black body binding (body / neck) really makes this guitar stand out. Its' construction is a Mahogany body and neck. Our Coupe De Ville series guitars are complete with a dark rich Ebony fretboard and custom 'brass knuckle' pearl inlays. It includes two Humbucker pick ups, a Tune-o-matic bridge, chrome Wilkinson die cast tuners, and a bone nut. It also includes a hard shell case.

One (1) third prize winner will receive a Pacific Drums & Percussion - concept Series Birch drum set (details below); and Chop Shop Series Bossman - Bossman II (red black finish) (details below. Approximate retail value of each prize is $1,800. The prize will be awarded directly to the person listed as the main contact on the Entry.
The details of the guitar for third prize package are as follows: The Coupe De Ville series Bombshell II is an Alder body, maple neck, dark rich Ebony fretboard with custom 'bomb' inlays, bone nut, chrome hardware, and three single coil pick ups. The body is a retro red with a bright white neck & headstock. It also includes a hard shell case.

The details for the Drum Set for all prize packages are as follows: The 4-piece set of DW-engineered drums includes 9x12 and 12x14 toms, matching 5.5x14 snare drum and 16x20 bass drum and is finished in a stage-stealing Charcoal to Natural Fade gloss lacquer. Other pro-quality features include STM (Suspension Tom Mounts), True Pitch Tuning, Proportional Flanged Counter Hoops, MAG Throw-Off System, die-cast claw hooks, Remo heads, and much more. A complete PDP 800 Series hardware pack with straight/boom cymbal stand, straight cymbal stand, snare stand, hi-hat stand, pedal are also part of the prize package.

For all Prizes: No warranty or guarantee will be given by Sponsor in respect to any prizes. Any and all guarantees and warranties are subject to the manufacturers or service providers terms and conditions, and winner agrees to look solely to such entity for any such warranty or guarantee claim. Prize is non-transferable. No substitution, assignment or transfer of prize permitted, except by Sponsor, who reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. Winner will be responsible for all applicable taxes (not limited to federal, state, local and/or income) on prize(s) and will be required to provide his/her Social Security number or tax ID for tax reporting purposes. Sponsor will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of prize. The prize will be awarded directly to the person listed as the Bands Main Contact on the Entry. For the grand prize, all members of the band that accept the prize will be equally responsible for all applicable taxes (not limited to federal, state, local and/or income) on grand prize.

12. Entry Conditions and Release
By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and Administrator which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor, Administrator, Live Nation Worldwide, Inc. and Facebook and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the Released Parties) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participants entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrants participation in the Contest and/or entrants acceptance, use or misuse of prize.

13. Publicity
Except where prohibited, participation in the Contest constitutes consent to Sponsor's and its agents' use of winning bands name, and/or hometown and state for any purposes in any media, worldwide, without further payment or consideration.

14. General Conditions
Sponsor and Administrator reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsors reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

15. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of entries; or (e) any injury, death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded.

16. Disputes
Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court located in the New York County, New York; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor and Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

17. Entrants Personal Information
Information collected from entrants is subject to the Sponsors Privacy Policy.

15. Contest Results
For Contest results send a hand-printed, self-addressed, stamped envelope to Winners List Mamba Battle of the Bands Contest c/o Storck USA, L.P. Attn: Mamba Contest, 325 N. LaSalle Street, Suite 400, Chicago, IL 60654. Requests for the winner list must be received by December 1, 2012.
