Selected artists will have their song recorded by a New Orleans based musician for a compilation to benefit the recovery from the effects of Hurricane Katrina./n/nThe Human Levee Music Project is a Song Competition open to any songwriter, musician, or band.



The goal of the Music Project is to bring songwriters and New Orleans musicians together to create an edgy, potent, and relevant music Compilation. This is a not-for-profit effort intended to benefit grassroots organizations in New Orleans which are actively engaged in helping citizens there recover from the effects of Hurricane Katrina.



Selected artists will have their song recorded by a New Orleans based musician with intent to create a marketable compilation to benefit the recovery from the effects of Hurricane Katrina.

The Musical Genre and Subject Matter of each song is open. Entrants may submit up to five (5) songs each. Each song should be approximately three (3) minutes in length not to exceed five (5) minutes. All song entries must be 100% original material, no sampling will be allowed. Winning songs will be chosen by a panel of music business professionals, and each song submission will be heard in its entirety. Songs are judged on originality, lyrics, melody, and composition. The quality of performance and production will not be a consideration.

Terms And Conditions

2009 HUMAN LEVEE MUSIC PROJECT SONGWRITER COMPETITION RULES & GUIDELINES FOR ENTRY

To enter by mail, please follow the instructions below.

1. Each entry must include:
(A) Completed entry form. All signatures must be original;
(B) CD or Audio Cassette(s) containing 1 song only;
(C) lyrics sheet;
(D) a check or money order for $7.00 per song submitted. Entrant may total all entries on 1 check (example: 5 entries = $35.00). Please make all checks and money orders payable to: Human Levee, LLC.

2. Every document and CD/cassette submitted must contain the following information:
(A) Entrant's full name;
(B) Entrant's telephone number;
(C) Entrant's email address
(D) title of the song; and
(E) the genre of the song.

3. All entries must be postmarked by September 6, 2009.

4. All songs submitted must be original and shall not infringe any copyrights or any other rights of any third parties. Songs may have multiple co-writers, but only one name should be designated as the Entrant on the entry form. Entrant shall, by entering, indemnify and hold The Human Levee Music Project (HLMP) harmless from and against any claims inconsistent with the foregoing. Submissions which include the sampling" of anothers work will not be considered.

5. Entrant may enter up to five (5) songs, but each entry requires a separate CD or cassette, lyric sheet and entry fee (For example: 5 song entries would cost $35.00). One check for multiple entries/categories is permitted. One package for multiple entries is also permitted. Entry fee is non-refundable. HLMP is not responsible for late, lost or damaged, misdirected, postage due, stolen or misappropriated entries. Cassettes, CDs and lyrics will not be returned.

6. Winners will be chosen by a panel of music business professionals. Songs are judged on originality, lyrics, melody and composition. The quality of performance and production will not be a consideration. Entrant acknowledges that all songs entered may be distributed to judges who will be selecting the winners, and Entrant agrees to release, indemnify, and hold HLMP, its sponsors, and judges harmless for liability, damages, or claims for injury or loss to any person or property relating to, in whole or in part, directly or indirectly, participation in HLMP Songwriter Competition.

7. Winners will be notified by mail and/or email, and must sign and return a Songwriter's Agreement confirming that winner's song is original and he/she holds rights to the song. Failure to sign and return the form within 15 days will result in immediate disqualification and an alternative winner will be selected. Entry constitutes permission to use winners names, likeness and voices for future publicity and advertising purposes without additional compensation. Winners will be determined within thirty (30) days after the end of the contest.

8. HLMP reserves the right to extend the deadline of the competition if needed.

10. Entrant retains all ownership rights to all submitted song(s). HLMP will not have any ownership rights to any song(s) submitted.

11. Winners will be awarded the opportunity to have their composition recorded by professional artists from, of, or associated with New Orleans, LA. The resulting Compilation will be marketed as a charitable CD to benefit grassroots organizations in New Orleans, LA. and/or any other organizations involved in helping New Orleans citizens recover from the effects of Hurricane Katrina.

12. By entering the HLMP Songwriter Competition, Entrant agrees to accept and be bound by the decisions of HLMP and its judges which are final and binding in all matters. Entrant agrees to be bound by all terms of these official HLMP Songwriter Competition Rules And Regulations as established herein.

2009 HUMAN LEVEE MUSIC PROJECT SONGWRITER COMPETITION SONGWRITER'S AGREEMENT

Dear Songwriter;

We are grateful that you have agreed to participate in the music project tentatively entitled Human Levee Music Project" (the Album") for the benefit of charities such as the Lower Ninth Ward Health Clinic, Unity of Greater New Orleans, the New Orleans affiliate of Habitat for Humanity, and/or any other organizations involved in helping New Orleans citizens recover from the effects of Hurricane Katrina. The Album will be recorded and manufactured for distribution (including, but not limited to, digital distribution) and sale by Human Levee, LLC and/or its designee(s) (the Foundation" or we"). All net royalties and net monies from the Album will benefit residents and evacuees of New Orleans. The terms net royalties" and net monies" as used herein refer to all royalties and other monies received by us in respect of the Album and/or other media now known or hereafter devised, less reasonable expenses, including but not limited to out of pocket" costs, mechanical royalties and licensing fees (to the extent not waived), union and guild payments, and legal fees.

The following are the terms of our Agreement:

1. OWNERSHIP : You own all copyrights in any Song (as defined below). This Agreement shall not transfer any copyright in any Song to the Foundation. You acknowledge that, as between you and us, all rights (including sound recording copyrights, but excluding your Song copyright) in and to the Album shall be owned and controlled by the Foundation, and that the Foundation shall be entitled to exploit the recording in connection with the distribution, sale, advertising and promotion of the Album throughout the universe in perpetuity.

2. WARRANTIES : You acknowledge that you donate one hundred percent (100%) of any and all royalties or other compensation in connection with the Album to the Foundation. You warrant and represent that there are no restrictions pertaining to your participation in this project and the rights you are granting the Foundation hereunder.

3. NAME AND LIKENESS : You acknowledge and agree that we, the Foundation and our respective designees will have the perpetual, worldwide right to use and to permit others to use your name, likeness, other identification and biographical materials concerning you solely for the purposes of trade and advertising in respect of the Album and records derived therefrom. We will only use (but are not obligated to use) photographs, bios and/or likenesses approved or provided by you.

4. LICENSES FOR MUSICAL COMPOSITIONS : In the event that any musical composition written by you (hereinafter, individually referred to as Song") is owned or controlled by you or your music publisher, you hereby cause the issuance of a mechanical license and synchronization license, if applicable, on a gratis basis to the Foundation and its designees in respect of the exploitation of the Song throughout the world in connection with the Album and records derived therefrom. Notwithstanding anything else contained herein, the Foundation is under no obligation to use any Song.

5. EDITORIAL CONTROL : You acknowledge and agree that the Foundation has editorial control over any Song submitted to make reasonable changes as needed, including but not limited to shortening the Songs playtime by cutting verses or other means and/or changing the Songs tempo or key signature. Editorial control shall not be exercised with the intent to alter the original or central meaning of any Song. Exercise of editorial control shall not alter original writers rights in any way, and co-writing credit will not be taken.

6. ENTIRE AGREEMENT : This agreement shall set forth our entire agreement with you; it may not be modified except in writing signed by you and the Foundation.
