The nation's most unique music competition among independent artists returns in 2008. It’s the Winery Music Awards competition. Unsigned. Unfiltered. It's not a showcase of wine country music--it's a wine country showcase of today's best independent music, each concert competition becoming a four-hour celebration of music, wine, food, creativity and originality. It is America’s most unique indie music competition! The competition is open to the musical genres of rock, blues, alternative, jazz, acoustic, country, folk, reggae' and adult contemporary.

Artists compete for significant prizes contributed by a variety of sponsor companies within and outside the music industry. What's more, you have the opportunity to perform your work for a host of notable judges influential in the music, entertainment and wine industries. Accomplished names in the music industry who judged the 2007 competition include Jon Anderson, of the legendary rock group, YES, Antonia Bennett, jazz singer and daughter of the great Tony Bennett, Jake Hooker, who wrote the classic hit "I Love Rock 'N Roll", and John Braheny, author of the songwriter's bible, "The Craft and Business of Songwriting."

Entry submissions are judged by a committee of music industry professionals in the categories of Originality and Marketability to men and women aged 25-54, a prime wine-consuming market. Artists among the best submission entries will be invited to perform at one of the two semifinal competition concerts in August where live performances will be judged in the category of Musicianship. In each of the two semifinal concerts, the two highest scoring artists advance to the final competition in October, along with one wild card winner. Finalists will be judged in all three categories.

Held in a bucolic outdoor setting in Paso Robles, the heart of California's scenic Central Coast wine region, attendees enjoy original music, visit a variety of tented kiosks on the grounds, sample many of the area's best wines and gourmet food, or purchase the work of some of California's best original artists and craftspeople.

    I hereby irrevocably grant to Kathy Kelly Productions, Inc. (Founder, Owner & Producer of the Winery Music Awards, herein referred to as Kelly), the absolute, exclusive, and unrestricted right and permission to record, copy, reproduce, publish, photograph, film, televise, broadcast, and otherwise exhibit in any and all markets and media (collected use) my (our) appearance, name, likeness, voice and all other documents and artifacts provided to Kelly by me (collectively the materials) solely for the purpose of promoting the event entitled Winery Music Awards. This grant of rights is made without limitation upon time.

    I hereby waive any right to inspect or approve the materials or the uses to which any of those materials may be put, including without limitation the website, and/or any related advertising and promotion of the above event.

    Recognizing the licensed parties reliance upon this agreement, I (we) hereby irrevocably release, discharge, and agree to indemnify and hold harmless the licensed parties and each of them from all actions, damages, costs, liabilities, claims, losses and expenses of every type and description (including attorneys fees and expenses) to which the licensed parties or any of them may be subject as a result of or in any way related to any use of the materials by any of the licensed parties, including without limitation any claim for violation, infringement or invasion of any copyright, trademark right, privacy or publicity right, defamation or any other right whatsoever that I (we) now have or may ever have resulting from or relating to any such use of the materials.

    I (we) agree that all audio and/or video recordings and/or still photographs of the materials during said event or any of them as well as all descriptions or summaries of my (our) personal history and/or views that are made and used by any licensed party will be solely owned by Kelly or their assigns.

    I (we) understand that my (our) audio file entries will be reviewed by the WMA Submission Qualification Committee which will determine the ten qualifying semi-finalists for the 2008 WMA competition out of all submissions received. I (we) understand that, if invited to perform as a semi-finalist, my (our) live performance will be judged by the WMA Concert Competition Judging Panel, which will determine the overall winner of the WMA.

    I (we) agree not to make contact with WMA judges by means of phone, email, mail, or any other mechanism at any time after my (our) submission has been entered to the WMA and throughout the period of the 2008 WMA event season.

    Nothing herein will constitute any obligation on any licensed party to warrant the ownership rights of the materials set forth above.

    I (we) agree that if, during the WMA competition, I (we), or any individual member of my (our) music group or road crew (a) is indicted with a misdemeanor involving acts of moral turpitude or any felony, (b) commits an act, or comes under investigation by a public authority for any act, which brings the Band or a Member into public disrepute and which thereby tarnishes the marks of the Winery Music Awards (the trademarks, service marks, insignia or logos designated by Kelly Productions, Inc.) or injures the potential commercial success of the Winery Music Awards, its Sponsors, Judges, Strategic Partners, or Advertisers, and/or any of the products or services of its Sponsors, Strategic Partners Judges, or Advertisers, or (c) shall make a statement in derogation of the Winery Music Awards, its Sponsors, Judges, Strategic Partners, or Advertisers, or their products or services and such statements are made to the general public or become a matter of public knowledge, then, at the time of any such act or at any time within ten (10) days after Kelly Productions, Inc. learns of any such act, the Artist/Band may be expelled from the 2008 WMA Competition.

    This License, Assignment and Release shall be governed by, and construed in accordance with, the law of the State of California, applicable to contracts entered into and to be fully performed therein.

    I (we) have read this License, Assignment and Release prior to signing it, and I (we) understand its contents.
